Your Rights
- If the police arrest you, you have the right to have the government assign you an attorney, and you can request one immediately.
- After your arrest, you may make a private phone call within a reasonable time. If the call is to your attorney, the police cannot listen to the conversation.
- If you are detained by ICE or by Customs and Border Protection (CBP), you have the right to hire an attorney at your own expense. You can also request a list of attorneys who provide free or low-cost legal assistance. If you remain in detention, you may make a call to contact your attorney or your family. In addition, your attorney has the right to visit you and represent you at your hearing before an immigration judge.
- You are not required to speak with an ICE agent without your attorney present.
